1. PREAMBLE, OBJECT AND CONTRACTUAL INTENT

These Terms and Conditions (“Terms”) govern access to and use of the website operated under the brand name Disha Stars, including subdomains, mobile applications, and related digital platforms. Disha Stars is operated by SAFALTA EDUCATION PRIVATE LIMITED, which is a subsidiary and part of AMAR UJALA (collectively referred to as the “Company”, “Disha Stars”, “we”, “us”, “our”).

These Master Terms and Conditions and User Guidelines are intended to operate as a comprehensive, legally binding, and enforceable contract governing every aspect of access to, interaction with, and use of the Disha Stars platform. These Terms apply irrespective of whether such access is intentional or incidental, registered or unregistered, paid or unpaid, direct or indirect, active or passive.

By accessing or using the Platform, you, the user (“User”, “you”, “your”) agree to be bound by these Terms, the Privacy Policy, and any other policies or guidelines published on the Platform. The User acknowledges that the Platform is a privately owned, commercially operated, rule-based digital ecosystem, and access to it is a conditional privilege subject to continuous compliance with these Terms.

2. COMPREHENSIVE DEFINITION AND SCOPE OF THE PLATFORM

For the purposes of these Terms, the term “Platform” shall be interpreted expansively. It shall include the Disha Stars website, all subdomains, mobile applications, dashboards, microsites, landing pages, campaign pages, and any digital interface through which the Company offers, facilitates, or supports Services.

“Group Companies” or “Affiliates” shall mean and include any entity that directly or indirectly controls, is controlled by, or is under common control with SAFALTA EDUCATION PRIVATE LIMITED, including but not limited to Amar Ujala Limited and its partner publications, digital portals, and education outreach channels.

The Platform further includes call-based counseling systems, IVR systems, recorded voice interactions, chat interfaces, messaging tools, emails, WhatsApp communications, automated bots, artificial intelligence tools, CRM infrastructure, backend databases, analytics engines, recommendation systems, algorithms, institutional dashboards, and documentation generated or maintained in connection with User interactions.

3. LEGAL ACCEPTANCE, ELECTRONIC CONSENT AND CONTINUING ASSENT

The User agrees and acknowledges that access to or use of the Platform constitutes valid and enforceable acceptance of these Terms through electronic means in accordance with the Indian Contract Act, 1872, the Information Technology Act, 2000, and other applicable laws. Such acceptance is deemed to occur immediately upon the User’s first access to the Platform.

The User further acknowledges that continued access or use of the Platform after any modification, update, or replacement of these Terms constitutes renewed and continuing assent to the revised Terms. The obligation to periodically review the Terms rests solely with the User.

Disha Stars may, either directly or through its parent and Group Companies (such as Amar Ujala), facilitate access to educational information, counseling services, skill-based learning programs, and admission-related assistance.

4. ELIGIBILITY, LEGAL CAPACITY AND USE BY MINORS

The User represents and warrants that they possess the legal capacity to enter into a binding contract under Indian law. Where the User is below eighteen (18) years of age, access to the Platform is strictly conditional upon the knowledge, supervision, and verifiable consent of a parent or lawful guardian.

The Company reserves the right to seek documentary proof, conduct verification calls, or deploy digital consent mechanisms to establish such parental or guardian consent. Any use of the Platform by a minor without valid consent shall be deemed non-compliant, and the Company may suspend or terminate access.

5. NATURE OF SERVICES AND ABSENCE OF GUARANTEES

The User expressly understands and agrees that Disha Stars operates solely as a technology-enabled information and facilitation platform. The Company does not itself conduct admissions, allocate seats, determine eligibility, award degrees, conduct examinations, accredit institutions, or guarantee academic, professional, or career outcomes.

All information relating to institutions, courses, fees, rankings, placements, or deadlines is indicative in nature, dynamic, and subject to change by third parties. The Company does not warrant the accuracy or completeness of such information. Any reliance placed on such information is entirely at the User's own discretion and risk.

6. COUNSELLING SERVICES – LIMITATION, CONTEXT AND NON-RELIANCE

Counseling services offered through the Platform are advisory and informational in nature only. Such counseling is based on a combination of User-provided inputs, historical trends, publicly available information, and institutional disclosures, and does not constitute professional, legal, financial, or academic advice.

The User acknowledges that counseling interactions do not create any fiduciary duty or guarantee on the part of the Company. All final decisions regarding admissions, enrollment, or career paths are taken independently by the User, and the Company shall not be liable for any consequences arising from such decisions.

7. REGISTRATION, ACCOUNT SECURITY AND USER OBLIGATIONS

Where registration or submission of information is required, the User undertakes to provide information that is true, accurate, current, complete, and lawful. The User agrees to promptly update such information to maintain its accuracy.

The User is solely responsible for maintaining the confidentiality of login credentials and for all activities carried out through their account. The Company shall not be liable for losses arising from credential sharing, negligence, or unauthorized access not attributable to any failure on the Company’s part.

8. ACCOUNT CREATION, AGE ELIGIBILITY AND USE OF THE PLATFORM BY CHILDREN

Access to certain features requires account creation or registration. The creation and continued use of an account is strictly conditional upon compliance with age requirements. It is acknowledged that a significant portion of Users may be students pursuing or having completed Class 10, Class 11, or Class 12, and accordingly, parental or lawful guardian involvement forms an integral part of Platform access and counseling workflows.

8.1 Users Who Are Eighteen (18) Years of Age or Above

Only individuals who are eighteen (18) years of age or above are permitted to independently create an account and access the Services. Such Users confirm they possess full legal capacity to enter into contracts and assume responsibility for all account activities.

8.2 Use of the Platform by Minors

Where a User is below eighteen (18) years of age, access to and use of the Platform is permitted strictly on the basis of the express, informed, and verifiable consent of the User’s parent or lawful guardian.

8.3 Verifiable Parental Consent Mechanism

For the purpose of obtaining and verifying parental or guardian consent, the Company may implement authentication mechanisms, including one-time password (OTP) verification sent to the parent’s registered mobile number/email, call-based verification, or digital acknowledgements.

8.4 Ongoing Supervision and Responsibility

The parent or lawful guardian undertakes to provide continuous supervision and oversight over the minor’s activities on the Platform. To the maximum extent permitted by law, the Company disclaims all liability arising from the acts, omissions, or decisions of a minor User.

8.5 Right to Suspend or Terminate

The Company reserves the right to suspend, restrict, or terminate any account where the age of the User has been misrepresented, or where parental consent is absent, withdrawn, or invalid.

9. APPLICATION FORMS, PAYMENTS AND USER RESPONSIBILITY

The User bears sole responsibility for ensuring the accuracy and completeness of all application details submitted through the Platform, compliance with institutional deadlines, and preservation of application IDs and transaction receipts.

Disha Stars shall not be responsible or liable for rejection, delay, or invalidation of applications arising from User error, late payments, missed deadlines, or institutional cut-offs. Refunds, if any, shall be governed strictly by the Refund & Cancellation Policy and applicable law.

9.1 USER GUIDELINES AND ACCEPTABLE USE POLICY

The User agrees to use the Platform in a lawful and ethical manner. The User shall not:

  • Provide false, misleading, or outdated information;
  • Misuse counseling services or data for spamming or commercial exploitation;
  • Upload or transmit defamatory, abusive, hateful, or objectionable content;
  • Attempt to compromise, reverse engineer, scrape, or gain unauthorized access to the Platform;
  • Use automated tools or scripts without prior written authorization.

10. COMMUNICATIONS, RECORDINGS AND CONSENT

The User expressly consents to receiving communications from the Company through telephone calls, SMS, emails, WhatsApp messages, push notifications, or other electronic means.

CRITICAL CROSS-PLATFORM INTERACTION CONSENT:
Any User who interacts with amarujala.com or any of its subdomains, portals, or partner channels and consents to share their contact information, explicitly agrees that their details may be shared with and processed by Disha Stars (operated by Safalta Education Private Limited). The User grants express authorization to Disha Stars and its affiliates to initiate communications including telephone calls, automated SMS messages, WhatsApp updates, and emails for educational counseling, admission assistance, and promotion of career-focused courses.

The User further consents to the recording, storage, analysis, and lawful use of calls and communications for purposes including quality assurance, training, compliance, analytics, dispute resolution, and legal defense. All communications shall be undertaken in compliance with applicable telecom and data protection laws, including TRAI regulations.

11. DATA PROTECTION, CONSENT AND REGULATORY COMPLIANCE

The Company processes personal data strictly in accordance with the Digital Personal Data Protection (DPDP) Act, 2023, and the Privacy Policy published on the Platform. Personal data is collected and processed only for lawful, specific, and legitimate purposes connected with service delivery and counseling.

The Company does not sell personal data. Sharing of data is strictly limited to service facilitation, partner institutions (where explicit consent is given), or legal/regulatory compliance. Withdrawal of consent by the User may result in the limitation or suspension of Services where such data is essential for delivery.

12. USER-GENERATED CONTENT AND LICENCE GRANT

Any content submitted by the User, including reviews, queries, or testimonial submissions, remains the sole responsibility of the User. By submitting content, the User grants the Company a perpetual, irrevocable, worldwide, royalty-free, transferable, and sublicensable license to use, store, modify, publish, and create derivative works of such content for all lawful Platform-related purposes.

13. MONITORING, INVESTIGATION AND ENFORCEMENT

The Company reserves the right to monitor User activity through manual and automated means for security, fraud detection, and quality control. The Company may investigate suspected violations and take enforcement action, including account suspension or reporting to law enforcement, without prior notice.

14. INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights in the Platform, including branding, logos, databases, software, design tokens, icons, and curated structures, vest exclusively with Safalta Education Private Limited or its parent group Amar Ujala. The User is granted a limited, revocable, non-transferable, and non-commercial license to access the Platform. Any unauthorized use attracts severe civil and criminal liability.

15. THIRD-PARTY INSTITUTIONS AND SERVICES

The Platform contains references, links, and brochures for third-party institutions (such as UPES, MMU, Sharda, IIMT). The Company does not control, endorse, or assume responsibility for these third parties. All interactions between the User and third-party institutions are at the User's own risk, and Disha Stars disclaims all liability arising therefrom.

16. TECHNOLOGY, DATA AND ALGORITHMIC LIMITATIONS

The User acknowledges that the Platform relies on digital networks and databases that may contain temporary errors. Rankings, recommendations, or course matching criteria are indicative only. The Company disclaims liability for technological failures, network outages, data loss, or algorithmic limitations.

17. DISCLAIMER OF WARRANTIES

The Platform and Services are provided on an “as is” and “as available” basis. The Company disclaims all warranties, express or implied, including accuracy, availability, fitness for a particular purpose, and non-infringement, except to the extent prohibited by law.

Users acknowledge that the liability of parent entities, including Amar Ujala, is limited as described herein, and any transaction-specific liability is restricted to the operating entity Safalta Education Private Limited.

18. LIMITATION OF LIABILITY

To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, consequential, special, or punitive damages. The aggregate liability of the Company shall not exceed the amount paid by the User for Services in the twelve (12) months preceding the claim. Nothing in these Terms shall exclude liability for fraud, willful misconduct, or statutory non-excludable obligations.

19. INDEMNITY

The User agrees to indemnify, defend, and hold harmless the Company, Safalta Education Private Limited, Amar Ujala, and their respective directors, employees, and agents from all claims, losses, liabilities, costs, and expenses arising from a breach of these Terms, misuse of the Platform, or violation of applicable laws.

20. ASSIGNMENT AND BUSINESS TRANSFERS

The Company may assign or transfer its rights and obligations under these Terms as part of mergers, acquisitions, restructuring, or the sale of business assets to other affiliates within the Amar Ujala group. The User may not assign their rights without prior written consent.

21. TERMINATION AND SURVIVAL

The Company may suspend or terminate access to the Platform at its sole discretion. Clauses relating to intellectual property, data protection, limitation of liability, indemnity, dispute resolution, and governing law shall survive any termination of these Terms.

22. DISPUTE RESOLUTION, GOVERNING LAW, AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India. All disputes, differences, or claims arising out of these Terms shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be New Delhi. Courts at NCT of Delhi shall have exclusive jurisdiction for interim and enforcement matters.

23. ENTIRE AGREEMENT, WAIVER, AND SEVERABILITY

These Terms, together with the Privacy Policy, constitute the entire agreement between the User and the Company regarding the Platform. Failure to enforce any provision shall not constitute a waiver. If any provision is found invalid, it shall be severed, and the remaining provisions shall continue in full force.

24. GRIEVANCE REDRESSAL

Users may raise grievances with the designated Grievance Officer, who will endeavor to resolve issues within the timelines prescribed by law.
