UPTET 2026: High Court Orders Removal of Two Questions from Evaluation
· Source: Amar Ujala
The High Court has ordered the Uttar Pradesh Education Service Selection Commission to exclude question numbers 36 and 37 of the UPTET 2026 master set from evaluation and revise candidates' scores. The court also sought the proposed schedule for upcoming general TET exams regarding the inclusion of Shikshamitras in Special TET.
High Court Order on UPTET 2026 Questions
The High Court has directed the Uttar Pradesh Education Service Selection Commission to exclude question numbers 36 and 37 of the UPTET-2026 master set from evaluation. The court instructed that equal benefit for these questions must be given to all affected candidates. Additionally, the commission has been ordered to recalculate the marks of the petitioners and correct their results and scorecards.
Arguments and Court Observations
Petitioners argued that in the final answer key, the commission accepted options B and D for question number 36, and options A and D for question number 37. However, marks were awarded only to candidates who selected one of these accepted options. The petitioners contended that when two correct answers are accepted, the questions should be excluded from evaluation. The commission claimed that the petitioners did not choose the correct options and had not objected to the provisional answer key. The court clarified that UPTET is a qualifying exam and evaluating questions with two accepted options is not appropriate, especially since the commission had already excluded question number 38 from evaluation in the same exam.
Exam Schedule Sought for Shikshamitras in Special TET
A division bench of Justice Saumitra Dayal Singh and Justice Swarupama Chaturvedi passed an order on a special appeal filed by 221 Shikshamitras, including Wasim Ahmad, seeking inclusion in the Special TET. The Allahabad High Court has asked the Education Service Selection Commission to submit the proposed schedule of upcoming general TET exams via an affidavit. The petitioners challenged the government order dated 2 September 2026 and the advertisement issued on 3 September, stating that giving contract-based special teachers the chance to appear while excluding qualified Shikshamitras violates Articles 14 and 16 of the Constitution.
